Использование стандартного бланка для изменения
документарного аккредитива
Использование изменения аккредитива посредством (авиа)почты
- Если аккредитив изменяется посредством (авиа)почты, то
всегда должен использоваться стандартный бланк для изменения
документарного аккредитива.
Использование в качестве рабочего изменения
- Если аккредитив изменяется посредством телетрансмиссионного
сообщения в ситуациях, упомянутых в подстатье 11 "ii" UCP 500, то
в дальнейшем стандартный бланк для изменения документарного
аккредитива должен использоваться как рабочее аккредитивное
изменение.
Нерабочие изменения
- Если телетрансмиссионное сообщение является рабочим
изменением, то согласно статье 11 "i" банк - эмитент не должен
посылать почтовое подтверждение.
Заполнение стандартного бланка для изменения документарного
аккредитива
1. Номер
- Номер аккредитива, в который вносятся изменения.
2. Дата изменения
- Обычно это дата выставления изменения.
- Если бланк используется в качестве рабочего изменения к
ранее переданному телетрансмиссионному сообщению, то дата должна
соответствовать дате, указанной в телетрансмиссионном сообщении.
- Если в телетрансмиссионном сообщении не была указана дата,
то датой будет считаться дата телетрансмиссионного сообщения.
- Таким образом, отметим: В последнем случае бланк должен
содержать следующее выражение: "Рабочее изменение в подтверждение
нашего телетрансмиссионного сообщения от... (дата)".
3. Место и дата выдачи
- Точно такие же, как и в аккредитиве, в который вносится
изменение.
4. Приказодатель
- Тот же, что и в аккредитиве, в который вносится изменение.
5. Бенефициар
- Тот же, что и в аккредитиве, в который вносится изменение.
6. Авизующий банк
- Обратите внимание на положение подстатьи 11 "b" UCP 500 о
том, что банк, пользующийся услугами другого банка или банков
(авизующего банка) для извещения об открытии аккредитива, должен
пользоваться услугами того же банка(ов) для извещения об
изменениях(ий) к аккредитиву.
7. Центральное поле бланка
- Здесь содержатся сведения, касающиеся изменения(ий).
8. Подпись
- Подписи уполномоченных лиц банка - эмитента должны
присутствовать на авизо для авизующего банка и на авизо для
бенефициара.
9. Уведомление авизующего банка
- Для использования авизующим банком, желающим известить
изменение без своего собственного сопроводительного письма или
авизо.

Использование стандартного бланка
для извещения документарного аккредитива
Обычно документарные аккредитивы поступают к бенефициарам
через авизующий банк.
Это в интересах бенефициара, поскольку статья 7 UCP 500
требует от авизующего банка с разумным вниманием проверить по
внешним признакам подлинность аккредитива, который он решил
авизовать.
Интересы бенефициара обеспечиваются уже самим использованием
стандартных документарно-аккредитивных бланков. Бенефициары также
оценят использование стандартных бланков для извещения
документарного аккредитива.
Стандартный бланк для извещения документарного аккредитива,
приводимый в Приложении 4:
- содержит информацию, которую бенефициару и авизующему банку
необходимо сохранить и занести в свои информационные системы,
- может быть использован независимо от того, запрошен ли
авизующий банк о добавлении своего подтверждения или нет.
Авизующий банк вправе отпечатать бланк со всеми необходимыми
дополнительными сведениями.
Независимо от того, подтверждает авизующий банк аккредитив или
нет, его авизо бенефициару должно содержать подпись(и)
уполномоченного лица.

Стандартные бланки ICC для документарных аккредитивов были
разработаны в интересах всеобщей стандартизации, единого
понимания, толкования и образа действий.
Разработанные на основе макетов ООН образцы бланков,
включенные в настоящее издание, представляют интерес для
приказодателей, бенефициаров и банков. Каждый из стандартных
бланков сопровождается подробным руководством, разъясняющим
содержимое его полей с тем, чтобы уберечь стороны, участвующие в
сделке, от возможных ошибок, неполноты или неточности изложения.
В настоящее издание включены стандартные бланки заявления на
открытие безотзывного документарного аккредитива, авизо для
бенефициара, авизо для авизующего банка, бланк продолжения
документарного аккредитива, бланк для изменения документарного
аккредитива и бланк уведомления о документарном аккредитиве.
Измененные в соответствии с новыми UCP 500, стандартные бланки
для документарных аккредитивов позволяют внести ясность и
единообразие в повседневное использование документарных
аккредитивов.
