СОГЛАШЕНИЕ
МЕЖДУ ПРАВИТЕЛЬСТВОМ РОССИЙСКОЙ ФЕДЕРАЦИИ И ПРАВИТЕЛЬСТВОМ
ЮЖНО-АФРИКАНСКОЙ РЕСПУБЛИКИ О СОТРУДНИЧЕСТВЕ В ОБЛАСТИ
ЗДРАВООХРАНЕНИЯ И МЕДИЦИНСКОЙ НАУКИ
(Кейптаун, 5 сентября 2006 года)
Правительство Российской Федерации (далее именуемое Российская
Сторона) и Правительство Южно-Африканской Республики (далее
именуемое Южно-африканская Сторона), далее вместе именуемые
Сторонами,
стремясь к развитию сотрудничества между обоими государствами
в области здравоохранения и медицинской науки,
сознавая целесообразность объединения усилий обоих государств
в решении ряда проблем в области здравоохранения, представляющих
взаимный интерес,
согласились о нижеследующем:
Статья 1
Предмет Соглашения
1. Стороны развивают сотрудничество в области здравоохранения
и медицинской науки на основе принципов равенства и взаимной
выгоды.
2. Сотрудничество в рамках настоящего Соглашения
осуществляется по следующим направлениям:
a) организация и финансирование здравоохранения, включая
медицинское страхование;
b) обучение и повышение квалификации медицинского персонала;
c) лекарственное обеспечение населения, регистрация и
реализация лекарственных средств;
d) научные исследования, технологии и информационные системы в
здравоохранении;
e) другие взаимосогласованные направления сотрудничества в
области здравоохранения и медицинской науки, о которых могут
договориться Стороны.
Статья 2
Содействие сотрудничеству
1. Стороны содействуют сотрудничеству путем поощрения и
поддержки установления прямых связей между российскими и
южноафриканскими научными и клиническими учреждениями и
организациями в области здравоохранения, медицинской науки и
управления здравоохранением.
2. Сотрудничество в рамках настоящего Соглашения будет
осуществляться главным образом путем:
a) обмена информацией;
b) обмена специалистами и делегациями;
c) участия специалистов в конгрессах и научных конференциях,
организуемых Сторонами; и
d) осуществления других согласованных форм сотрудничества в
области здравоохранения, медицинской науки и государственных служб
охраны здоровья, включая вопросы санитарно-эпидемиологического
благополучия населения.
Статья 3
Создание Рабочей группы
1. Создается совместная Рабочая группа из представителей обеих
Сторон и других организаций, участвующих в сотрудничестве в рамках
настоящего Соглашения.
2. Для практической реализации настоящего Соглашения Рабочая
группа:
a) разрабатывает программы сотрудничества;
b) определяет конкретные формы, методы и условия
сотрудничества; и
c) подводит итоги и анализирует результаты сотрудничества.
3. Рабочая группа состоит из представителей Сторон и других
организаций, участвующих в сотрудничестве, и по мере необходимости
проводит совещания на территории государства любой из Сторон.
Статья 4
Обмен информацией
Стороны обмениваются информацией об опыте и результатах
сотрудничества со Всемирной организацией здравоохранения и другими
международными организациями, действующими в сфере
здравоохранения.
Статья 5
Особые условия
Граждане Российской Федерации и Южно-Африканской Республики,
нуждающиеся в медицинской помощи во время пребывания на территории
государства другой Стороны, получают эту помощь на условиях,
определяемых действующим законодательством в области
здравоохранения в данном государстве в период действия настоящего
Соглашения.
Статья 6
Компетентные органы
Компетентными органами, ответственными за выполнение
настоящего Соглашения, являются:
a) с Российской Стороны - Министерство здравоохранения и
социального развития Российской Федерации,
b) с Южно-Африканской Стороны - Министерство здравоохранения
Южно-Африканской Республики.
Статья 7
Решение спорных вопросов
Любые разногласия между Сторонами, связанные с толкованием или
применением настоящего Соглашения, разрешаются на дружественной
основе путем консультаций или переговоров между Сторонами.
Статья 8
Поправки к Соглашению
В настоящее Соглашение по взаимному согласию Сторон могут быть
внесены изменения и дополнения.
Статья 9
Срок действия Соглашения
1. Настоящее Соглашение вступает в силу со дня его подписания.
2. Настоящее Соглашение заключается сроком на пять лет, после
чего автоматически продлевается на очередные пятилетние периоды до
истечения 6 месяцев со дня, когда одна из Сторон письменно
уведомит другую Сторону о своем намерении прекратить действие
Соглашения.
В удостоверение чего нижеподписавшиеся, должным образом на то
уполномоченные своими соответствующими правительствами, подписали
и скрепили печатями настоящее Соглашение в двух экземплярах,
каждый на русском и английском языках, причем оба текста имеют
одинаковую силу.

AGREEMENT
BETWEEN THE GOVERNMENT OF THE RUSSIAN FEDERATION AND THE
GOVERNMENT OF THE REPUBLIC OF SOUTH AFRICA ON CO-OPERATION
IN THE FIELD OF HEALTH AND MEDICAL SCIENCE
(Cape Town, 5.IX.2006)
The Government of the Russian Federation (hereinafter
refferred to as Russia) and the Government of the Republic of
South Africa (hereinafter refferred to as South Africa)
(hereinafter jointly referred to as "the Parties" and in the
singular as a "Party");
Desirous to develop co-operation between the two countries in
the field of health care and medical science;
Recognising the expediency of combining efforts of both
countries in solving a number of problems in the field of health
care that are of mutual interest,
Hereby agree as follows:
Article 1
Scope of Agreement
(1) The Parties shall promote co-operation in the field of
health and medical science based on the principles of equality and
mutual benefit.
(2) Co-operation within the framework of this Agreement shall
consist of the following:
(a) management and financing of health care, including medical
insurance;
(b) training and professional development of medical staff;
(c) pharmaceutical services, registration and procurement of
medicines;
(d) scientific research, technology and information systems in
the field of health care; and
(e) other directions of co-operation in the field of health
care and medical science that may be agreed upon by the Parties.
Article 2
Promotion of co-operation
(1) The Parties shall promote co-operation by encouraging and
supporting the establishment of direct contacts between the
Russian and South African scientific and functional institutions
and organizations in the field of health care, medical science and
management of health services.
(2) The co-operation within the framework of this Agreement
shall mainly be carried out by means of:
(a) exchange of information;
(b) exchange of specialists and delegations;
(c) participation of specialists in the forums and scientific
conferences organised by the Parties; and
(d) implementation of other forms of co-operation in the field
of health care, medical science and public health services,
including the question of sanitary and epidemiological well-being
of the population.
Article 3
Establishment of Working Group
(1) A joint Working Group consisting of delegates from both
Parties and other organizations taking part in co-operation shall
be established.
(2) For the purpose of practical implementation of this
Agreement the Working Group shall:
(a) work out programmes of co-operation;
(b) define forms, methods and terms of co-operation; and
(c) summarise and analyse the results of co-operation.
(3) The Working Group shall consist of the representatives of
the Parties and other organisations, participating in the
co-operation, and shall hold meetings in either country as the
need arises.
Article 4
Exchange of information
The Parties shall exchange information on experiences and
results of co-operation with the World Health Organisation, as
well as with other international organisations, acting in the
field of health care.
Article 5
Special conditions
Citizens of the Russian Federation and the Republic of South
Africa, who need medical assistance during the period of their
stay in the other country, shall receive such assistance on the
conditions determined by legislation in the field of health care
effective in that country during the period when this Agreement is
in force.
Article 6
Competent authorities
The competent authorities responsible for the implementation
of this Agreement shall be:
(a) in the case of the Russian Federation, its Ministry of
Health and Social Development; and
(b) in the case of the of South Africa, its national
Department of Health.
Article 7
Settlement of disputes
Any dispute between the Parties arising out of the
interpretation or implementation of this Agreement shall be
settled amicably through consultations or negotiations between the
Parties.
Article 8
Amendments to the Agreement
This Agreement may be amended by mutual consent of the Parties
through consultations or negotiation between the Parties.
Article 9
Entry into force and termination
(1) This Agreement shall enter into force on the date of
signature thereof.
(2) This Agreement shall remain in force for a period of five
(5) years whereafter it shall automatically be extended for
another five (5) years, but may be terminated by either Party
giving six months written notification in advance through the
diplomatic channel of its intention to terminate this Agreement.
In witness whereof the undersigned, being duly authorised
thereto by their respective Governments, have signed and sealed
this Agreement in two originals in the Russian and English
languages, with both texts being equally authentic.
